Terms of Service
We convert one cryptocurrency into another. You do not need an account. The amount we show you before you deposit is an estimate, not a promise. The final amount depends on the market, network costs, and when your deposit confirms. Send exactly the asset and network shown in your order. Keep your order ID. If we cannot complete your order, we return your funds to the refund address you gave us, less network costs.
This summary is for convenience and is not part of the agreement. The numbered sections below are.
1. Who these terms are between
These Terms of Service (the “Terms”) form a binding agreement between you (“you”, the “customer”) and the operator of buysellcrypto.exchange, trading as BuySellCrypto Exchange (“we”, “us”, “our”). You can reach us at any time at support@buysellcrypto.exchange.
These Terms apply to the website at buysellcrypto.exchange and to every exchange order created through it. By creating an order, depositing funds, or otherwise using the site, you accept these Terms. If you do not accept them, do not use the service.
Our Privacy Policy, Cookie Notice, AML & Acceptable Use Statement, and Restricted Jurisdictions list are incorporated into these Terms by reference.
2. What the service is
We provide a cryptocurrency-to-cryptocurrency exchange service. You tell us the asset and network you are sending, the asset and network you want to receive, an amount, and a receiving address. We give you an order ID, a deposit address, and (where the asset requires one) a memo or destination tag. When your deposit is confirmed on the relevant blockchain, we convert it and send the output to your receiving address.
What the service is not:
- It is not a wallet, a custodian, or a place to store funds. We hold your funds only for the time needed to complete your order.
- It is not a broker, an investment service, a fiat payment service, or a lending or yield product.
- It does not give investment, tax, accounting, or legal advice. Nothing on the site is a recommendation to buy or sell any asset.
- It is not a bank, and funds handled through it are not deposits and are not covered by any deposit-protection or investor-compensation scheme.
3. Eligibility
To use the service you confirm that:
- you are at least 18 years old and have legal capacity to enter this agreement;
- you are not located in, resident in, or acting on behalf of a person in a jurisdiction on our Restricted Jurisdictions list;
- you are not a person subject to sanctions administered by the United Nations, the European Union, the United Kingdom (OFSI) or the United States (OFAC), and you are not acting for such a person;
- the funds you send are lawfully yours and are not the proceeds of crime;
- your use of the service is lawful where you are.
You are responsible for knowing and following the law that applies to you. We do not advise you on whether the service is lawful in your location.
4. Creating an order
An order is created when you submit the exchange form with a valid receiving address and we return an order ID. At that point we show you:
- the order ID;
- the deposit address, and a memo or destination tag if the asset requires one;
- the asset, network, and amount you are expected to send;
- the estimated amount you will receive;
- whether the order uses a floating rate or a fixed rate.
Creating an order does not commit you to anything and does not move any funds. Your order becomes live only when your deposit reaches the deposit address and confirms on-chain. An order for which no deposit arrives within 60 minutes expires and must be recreated.
Each order has minimum and maximum amounts that depend on the asset. These are shown in the form and enforced when the order is created. A deposit outside those limits is handled under section 9.
Keep your order ID. It is how we identify your order. Support cannot reliably locate an order without it, and if you also keep your deposit transaction hash we can resolve almost any problem.
5. Rates, estimates, and rate locks
5.1 Estimates
Unless you have selected a fixed rate, the receive amount shown to you is an estimate calculated from reference market prices at the moment it is displayed. It is not an offer, a quotation you can hold us to, or a guarantee of the amount you will receive.
5.2 Floating rate
On a floating-rate order, the rate applied is the rate available when your deposit confirms and the conversion is executed. The final amount may be higher or lower than the estimate. Causes include market movement between deposit and execution, blockchain confirmation time, network fees, spread, and available liquidity in the pair.
5.3 Fixed rate
On a fixed-rate order, we hold the quoted rate for 15 minutes from order creation, provided your deposit is received and confirms within that window and the deposited amount matches the order.
If the deposit arrives late, arrives for a different amount, or confirms after the window closes, the fixed rate no longer applies. In that case we will, at your choice where practical, either execute at the rate then available or return the deposit under section 9. Fixed-rate orders may carry a different spread from floating-rate orders; see section 6.
5.4 Reference prices
Reference prices come from third-party market data providers. We do not control that data and are not liable for its accuracy, completeness, or availability. If pricing data is unavailable, order creation may be suspended.
6. Fees and network costs
The estimate shown to you is inclusive of our spread. Our current pricing is:

We do not charge a separate account, withdrawal, or inactivity fee, because there is no account. We may change pricing at any time; the pricing that applies to your order is the pricing in force when the order is created.
7. Your responsibilities when depositing
Blockchain transactions cannot be reversed by us or by anyone else. Almost every irrecoverable loss in this business comes from the four mistakes below.
You are responsible for:
- Sending the correct asset. Send only the asset shown in your order.
- Using the correct network. Many assets exist on several networks. USDT on TRC-20 and USDT on ERC-20, for example, are not interchangeable. Send only on the network shown in your order.
- Including the memo or destination tag where your order shows one. A deposit sent without a required memo or tag may be unattributable to your order.
- Giving a correct receiving address on the correct network, and a correct refund address. We send to the address you give us. We cannot recall a payout sent to an address you entered incorrectly.
Additionally: send one deposit per order; do not send a second payment to the same deposit address; and do not reuse a deposit address from an expired or completed order, because deposit addresses are assigned per order and a deposit to a stale address may not be attributable to you.
8. Processing and payout
Once your deposit confirms on-chain, your order is checked and the payout is prepared and sent to your receiving address.
Confirm your deposit in the order screen after you send it. This tells us to look for it and is the fastest route to your payout.
Target timings, which are targets and not guarantees:

Timings depend on the confirmation requirements of the networks involved, network congestion, and liquidity in the pair. If your order exceeds the target above, contact support with your order ID and we will tell you its status and the reason for the delay.
Payout is complete when we broadcast the payout transaction to the destination network. We are not responsible for the time the network then takes to confirm it, nor for a destination wallet, exchange, or service that fails to credit, delays crediting, or rejects a validly broadcast transaction.
9. Cancellations, refunds, and incomplete orders
9.1 Before you deposit
You can abandon an order at any time before depositing. There is nothing to cancel and no charge.
9.2 After you deposit
Once a deposit has confirmed on-chain, the order cannot be cancelled on demand, because the conversion may already be executed. Contact support immediately with your order ID and we will tell you what is still possible.
9.3 When we return funds
We will return your deposit if:
- the deposited amount is below the minimum or above the maximum for the order and we cannot execute it;
- the pair became unavailable before execution;
- a fixed-rate order lapsed under section 5.3 and you choose a refund over the rate then available;
- we decline the order under section 12;
- we cannot complete the order for any other reason.
Refunds are sent to the refund address on your order, or to the deposit's originating address where no refund address was given and the originating address can be determined. Refunds are made in the asset deposited, not converted. The network fee for the refund is deducted from the amount returned. We target one business day for refunds after the decision to refund is made.
9.4 Unclaimed or unreturnable funds
If we cannot return funds because no valid refund address exists and you do not respond to a request for one within 12 months, we keep holding the funds and they stay claimable by you on proof that you made the deposit. We do not take unclaimed deposits as our own.
10. Wrong asset, wrong network, wrong address
We would rather tell you this plainly than have you discover it after the fact.

We will make reasonable efforts to help in the recoverable cases. We do not promise recovery, we do not accept liability for a deposit that does not match your order, and we will not misrepresent an unrecoverable loss as recoverable.
11. Prohibited use
You must not use the service:
- to launder money, finance terrorism, or move the proceeds of any crime;
- to evade sanctions, or on behalf of a sanctioned person, entity, or jurisdiction;
- with funds obtained by fraud, theft, extortion, ransomware, or the compromise of any system or account;
- to fund or profit from trafficking in people, weapons, controlled substances, or child sexual abuse material;
- to conduct market manipulation or any securities offence;
- to evade tax, or to conceal assets from a court, insolvency practitioner, or lawful authority;
- on behalf of another person whose identity you conceal from us when we have asked;
- by automated means designed to overload, scrape, or disrupt the site, or to test its security without our written permission;
- by structuring orders into smaller amounts to stay under a threshold in these Terms or in our AML & Acceptable Use Statement;
- in any way that breaks the law that applies to you.
We take these seriously. Orders we believe fall into these categories are declined, and we cooperate with lawful requests from competent authorities.
12. Order review, information requests, and refusal
We do not ask you to open an account or upload identity documents to place a standard order. That is the normal path and it is how the great majority of orders complete.
We do, however, reserve the right to review an order and to ask you for information before completing it. We may do so where:
- the order exceeds the equivalent of EUR 1,000 in value;
- the deposit or destination address appears in a sanctions listing or is associated with a known theft, exploit, ransomware campaign, darknet market, or mixing service, according to the analytics sources we use;
- a pattern of orders appears structured to avoid a threshold;
- we are required to by law, by a court, or by a competent authority;
- we have a reasonable, specific concern that completing the order would breach section 11.
If we ask for information, we will tell you what we need and why. If you decline to provide it, we will not complete the order and will refund it under section 9, unless a law or a lawful order prevents us from doing so.
We may decline any order at our discretion, and we may suspend the service. Where we decline an order after receiving your deposit, you get a refund under section 9. Where we are legally prohibited from telling you why an order is held or declined, we will tell you as much as we lawfully can.

13. No account, no custody, no interest
The service has no customer accounts, no balances, and no stored value. We hold your funds only for the interval between confirmation of your deposit and broadcast of your payout or refund. You accrue no interest, yield, or reward on funds during that interval, and you have no claim to any yield we may earn.
We are not your fiduciary, trustee, agent, or adviser.
14. Support
Support is available by email at support@buysellcrypto.exchange and through the chat window on the site.
Coverage: Seven days a week. Target first response: under an hour in chat, and 12 hours by email.
The chat window on our site can explain how the service works, walk you through the order flow, and point you to the right document. It cannot look up your order, confirm a deposit, quote a binding rate, or change an order. For anything touching your funds or your specific order, email support with your order ID.
Always include your order ID, and where relevant the deposit transaction hash. We will never ask you for your wallet's private key, seed phrase, or recovery words. Nobody legitimate ever will. If a message claiming to be from us asks for them, it is not from us.
15. Risk acknowledgement
You acknowledge that:
- cryptoasset prices are volatile and the value of what you receive may fall;
- blockchain transactions are irreversible and cannot be recalled by us;
- blockchains, wallets, bridges, and smart contracts can fail, fork, halt, congest, or be exploited, and such events are outside our control;
- the legal and tax treatment of cryptoassets may change, possibly with retrospective effect;
- you are responsible for your own tax reporting and payment;
- you are responsible for the security of your own wallet and devices;
- cryptoasset services are, in many jurisdictions, outside the scope of financial-services compensation schemes and ombudsman services.
16. Limitation of liability
Nothing in these Terms excludes or limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any liability that cannot lawfully be excluded.
Subject to that, and to the maximum extent permitted by law:
- the service is provided on an “as is” and “as available” basis, without warranty of uninterrupted or error-free operation;
- we are not liable for loss of profit, loss of opportunity, loss of anticipated gain, trading losses, or any indirect or consequential loss;
- we are not liable for losses caused by an act or omission of yours, including any of the mistakes in sections 7 and 10;
- we are not liable for losses caused by a third party we do not control, including blockchain networks, wallet providers, market-data providers, and destination platforms;
- we are not liable for losses caused by an event beyond our reasonable control, including network failure, chain reorganisation or halt, exploit of a third-party protocol, regulatory action, or the unavailability of a counterparty;
- our total liability arising out of or in connection with a given order is limited to the value of the deposit you sent for that order, measured at the time we received it.
17. Indemnity
You agree to indemnify us against any claim, loss, liability, or cost (including reasonable legal fees) arising from your breach of these Terms, your breach of section 11, or any inaccurate information you give us.
18. Intellectual property
The site, its content, design, code, and marks belong to us or our licensors. You may use the site to create and complete your own exchange orders. You may not copy, resell, frame, scrape, reverse-engineer, or create derivative works from it without our written permission.
19. Changes to the service and these terms
We may change, suspend, or withdraw the service, any supported asset, or any pair at any time.
We may amend these Terms. The version in force when your order is created is the version that governs that order. We will post the amended version here with an updated date, and we will notify material changes on the site for at least 14 days before they take effect. Continuing to use the service after a change takes effect means you accept it.
20. Governing law and disputes
These Terms are governed by the law of the country in which you are resident, and you may bring proceedings in the courts of that country. Nothing in these Terms takes away a right you have under the mandatory consumer law of that country.
If you have a complaint, raise it first with support@buysellcrypto.exchange, with your order ID and what you would like us to do. We will acknowledge within two business days and give a substantive response within 15 business days. If that response does not settle it, you keep every right you have under the law of your country of residence, including taking the matter to the courts there.
If you are a consumer, nothing here removes the protection of the mandatory consumer law of your country of residence, or your right to bring proceedings in your local courts where that law gives you one.
21. General
Entire agreement. These Terms and the documents incorporated into them are the whole agreement between us on their subject matter.
Severance. If a provision is found unenforceable, the rest continues in force.
No waiver. A delay in enforcing a right is not a waiver of it.
Assignment. You may not assign your rights under these Terms. We may assign ours to a successor of our business, on notice posted to the site.
No third-party rights. No person other than you and us may enforce these Terms.
Language. These Terms are written in English. A translation is provided for convenience only, and the English version governs.
